The terms on which we quote, erect, hire, inspect and dismantle scaffolding across Kent, Sussex and London.
About these terms
These terms apply to all scaffolding work quoted and carried out by Thompsons Towers Scaffolding Services Ltd, 10 Carpenters Ln, Hadlow, Tonbridge, Kent TN11 0HW. They apply alongside the written quotation we issue for your job; where the quotation says something different, the quotation takes precedence.
Quotations and surveys
Site surveys are free of charge. Written quotations are issued within one day of the survey and are based on the access, ground conditions, dimensions and scope seen or described at that time. If the scope changes, the property differs from what was described, or additional lifts, ties, fans, boarding or hire time are required, we will agree the additional cost with you in writing before carrying out that work.
Hire period
Unless the quotation states otherwise, the price includes erection, a six-week hire period, and dismantle and collection. If the scaffold is required beyond the agreed hire period, an extension is agreed in writing and charged at the rate stated in the quotation. Please give us as much notice as you can when your works are complete so we can book the dismantle.
Access and site conditions
You are responsible for providing safe and clear access to the working area on the agreed dates, including moving vehicles, garden furniture, plants and other obstructions, and for confirming that the ground is capable of taking the scaffold loads. Where scaffold must be tied into the building, sit on a neighbour's land, overhang a highway or a footpath, you are responsible for obtaining the necessary permissions or licences unless we have agreed in writing to obtain them for you. Wasted journeys caused by inaccessible sites may be charged.
Safety, alterations and use
Scaffolds are erected to TG20 compliant configurations by CISRS-carded scaffolders and are handed over with a scaff tag. Where a structure falls outside standard configurations we can supply design drawings and calculations at extra charge. Once handed over, no one may alter, strike, extend, overload or remove any part of the scaffold, including ties, boards, guardrails, toe boards, brick guards, netting or sheeting. If you believe the scaffold has been altered, damaged or affected by weather or a vehicle strike, stop using it and contact us immediately. We carry out weekly inspections for the duration of the hire and record them.
Care of equipment
All scaffolding materials remain our property at all times. From handover until collection you are responsible for the security of the equipment on your site and for loss or damage caused by theft, vandalism, misuse or third parties, and such loss or damage will be charged at replacement cost.
Payment
Payment terms are as stated on your quotation or invoice. Where a deposit is required, work is booked once it is received. Invoices are payable by the due date shown; we reserve the right to charge interest and reasonable recovery costs on overdue accounts under the Late Payment of Commercial Debts (Interest) Act 1998 where it applies.
Cancellation and dates
Please give us as much notice as possible if you need to cancel or move a booked date; costs already incurred, such as mobilisation, permits or hired-in items, may be charged. Erection and dismantle dates are given in good faith and we work hard to hold them, but they may be affected by weather, high winds, site conditions or matters outside our reasonable control.
Insurance and liability
We hold £10 million public liability and £10 million employers' liability insurance; certificates are available on request. We are responsible for loss or damage caused by our negligence or breach of contract. We are not liable for loss or damage arising from unauthorised alteration or misuse of the scaffold, from defects in the building or ground that were not reasonably apparent at survey, or for indirect or consequential losses such as lost profit or delay costs of other trades. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Consumer cancellation rights
Where you are a consumer and the contract is agreed away from our premises, you have a right to cancel within 14 days. If you ask us to start work within that period and then cancel, we may charge for the work carried out up to the point of cancellation.
